• Customer: A User who registers on the Platform to find, connect with, and potentially hire a Professional for a construction, design, or renovation project.

• Professional: A User who registers on the Platform to offer their services. This includes, but is not limited to, contractors, architects, civil engineers, and interior designers.

• Service: The service provided by FirstBrix is a neutral online marketplace that connects Customers with Professionals.

## 2. The FirstBrix Platform

FirstBrix provides a technology platform to facilitate connections. You acknowledge and agree that:

• FirstBrix is not a party to any agreement, contract, or transaction between a Customer and a Professional.

• FirstBrix is not a construction company, contractor, or agent. We do not perform any construction or design work ourselves.

• While we may have a verification process for Professionals, we do not endorse, guarantee, or warranty the quality, safety, legality, or performance of any Professional or their work.

## 3. User Accounts and Obligations

• Eligibility: To use this Platform, you must be at least 18 years of age and capable of entering into legally binding contracts.

• Account Accuracy: You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate. You are solely responsible for all activities that occur under your account.

• Privacy: Your use of the Platform is also governed by our Privacy Policy.

## 4. Terms Specific to Customers

• Free to Use: The Platform is free for Customers to search for Professionals and request quotes.

• Due Diligence: You are solely responsible for conducting your own due diligence before hiring a Professional. This includes, but is not limited to, checking licenses, references, and past work, and entering into a formal, written contract.

• Contracts with Professionals: Any agreement you enter into with a Professional is strictly between you and them. FirstBrix will not be a party to that agreement and is not responsible for its execution or enforcement.

• Reviews: You may be asked to leave a review for a Professional. You agree that any review you provide will be truthful, accurate, and based on your firsthand experience.

## 5. Terms Specific to Professionals

• Verification: You agree to undergo our verification process and provide accurate information regarding your identity, business, licenses, qualifications, and experience.

• Independent Contractor Status: You acknowledge that you are an independent contractor and not an employee, partner, or agent of FirstBrix. You are responsible for your own taxes, insurance, and business expenses.

• Responsibility for Services: You are solely responsible for the quality, legality, and safety of the services you provide to Customers. You agree to perform all work in a professional, workmanlike manner and in compliance with all applicable laws and building codes.

• Profile Content: You are responsible for all content you post on your profile, including portfolio images. You must have the legal right to use any content you upload.

## 6. Financial Terms

• For Customers: There are no fees for Customers to use the Platform. All payments for project work are to be made directly to the Professional as per the terms of your separate contract with them.

• For Professionals: You agree to pay all applicable fees, which may include subscription fees or commission/success fees, as outlined at the time of registration or project acceptance.

• Non-Refundable Policy: All fees paid by Professionals to FirstBrix are final and non-refundable. This includes subscription fees for access to the Platform and commission fees for successfully secured projects. The service is considered rendered upon payment or upon a successful match being made.

## 7. Disclaimer and Limitation of Liability

FirstBrix.com is a neutral technology platform. We are not a party to the agreements entered into between Customers and Professionals.

FirstBrix.com shall not be liable for any damages, claims, disputes, or losses, including but not limited to fraud, theft, negligence, misconduct, poor workmanship, project delays, payment disputes, or any other criminal or civil action, arising from the interactions or services provided by a Professional sourced through our Platform.

The Platform is provided "AS IS" without any warranties. We do not guarantee that the Platform will be error-free or that any information provided is accurate.

## 8. Governing Law and Jurisdiction

These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the Republic of India.

You agree that the courts located in Latur, Maharashtra, India shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with your use of the FirstBrix.com Platform.

## 9. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
